A man charged in connection with the 2011 abduction and sexual assault of a five-year-old boy is a repeat sex offender.
Hugh Alexander McCurry briefly appeared in Brandon provincial court on Monday, after being released on conditions by police following his arrest.
McCurry, 38, is charged with abduction of a child under 14 years old, sexual assault, sexual interference and invitation to sexual touching.
The charges relate to a five-year-old boy who was abducted while playing with other children outside his Stickney Avenue home on Dec. 12, 2011.
Brandon police believe the boy got in the suspect’s vehicle willingly.
The boy was driven to a spot on the north side of the Assiniboine River, near the Discovery Centre, and sexually assaulted in the vehicle, police said.
The man then dropped the boy off on the south side of the river. The child appeared physically unharmed.
Meanwhile, the young girls who had been playing with the boy, had notified his father. The girls provided a description of the vehicle and direction of travel.
Thirty to 45 minutes after the boy went missing, police found him wandering the area near the south side of the river.
A suspect wasn’t found at the time, and wasn’t identified until nearly four years later, in October of this year.
As reported shortly after the arrest, police said advances in DNA testing had produced a "hit" on the National DNA Databank, which is used to match DNA profiles from crime scenes to convicted criminals.
In this case, samples of bodily fluid taken from the boy's clothing were sent for testing.
The abduction and assault of the boy appeared to be random, as police said it appears the accused and the victim’s family didn’t know each other.
Police didn't release the name of the accused when they announced the arrest in October, but his appearance in court now allows him to be named.
McCurry is a repeat offender with a record for sex offences that dates back to 1999.
That record includes prior convictions for sexual interference, committing an indecent act and sexual assault.
His past crimes include exposing himself to 11-year-old girls. In 2004, he was jailed for sexually assaulting a woman by fondling her as she slept. In 2007, he received 15 months in jail for repeatedly fondling and engaging in oral sex with a 10-year-old girl.
At the time of the offences against the 10 year old, he was on a probation order that forbid him from having contact with children under 14 years of age.
Despite that criminal history, McCurry is presumed innocent of the current allegations regarding the abduction and sexual assault of the five-year-old boy.
Police released him following his Oct. 26 arrest on those accusations.
Under the conditions of his release, he’s not to be within 100 metres of a park, playground, school ground, community centre or any place children under 16 years old are present or may be present.
He’s also not to be in the company of anyone under 16, unless a parent or guardian who’s aware of his charges is present.
