Lying about assault nets $1,000 fine

She chose to falsely accuse her common-law husband of assault, rather than admit she was having an affair.

Now she’ll pay the price for her lie in the form of a $1,000 fine.

“Honesty is the better policy,” Judge Krystyna Tarwid advised as she imposed the fine in Brandon court on Monday.

Crown attorney Grant Hughes said that a woman went to city police and made the false report on Oct. 28.

She claimed she’d been out all night driving intoxicated friends around, but hadn’t been drinking herself.

When she returned home at 10 a.m., she was confronted by her common-law spouse who demanded to know what she’d been doing. He then kicked and punched her before she fled the home, she falsely claimed.

The woman did have injuries — a swollen cheek, a bruised eye, bloody nose, and red marks and a bruise on her forearm.

Police went to the couple’s home and arrested the spouse who told a different version of events.

He said his wife had phoned him to say she was at a party and wouldn’t come home. When she finally came home in the morning, he spotted her injuries and asked what happened.

The wife got angry and threatened to call police to tell them that her husband had kicked and punched her and threatened to kill her with a knife.

The man, an immigrant, said that his wife told him she wouldn’t care if he was deported due to her false allegations — even though they have a young child together.

The husband called his wife’s mother who picked the screaming woman up.

Police did arrest and charge the husband with assault, but had their doubts about the wife’s story.

At the time of her statement to police she’d claimed she hadn’t been drinking, but an officer noted the scent of alcohol on her breath.

She’d also asked if her common-law husband would be kicked out of the country.

A week later, during further questioning, she broke down and admitted she’d lied.

In reality, she was having an affair with another man and they got caught by his pregnant girlfriend who then beat her up.

Unwilling to tell her mom she was having an affair, the 30-year-old lied and said her husband had assaulted her. The mom, in turn, told her daughter make a report to police.

In court on Monday, the woman pleaded guilty to public mischief and Tarwid fined her $1,000.
