Man pleads guilty in brother's stabbing

A man who was stabbed multiple times during a New Year’s Eve party forgives the man who wielded the knife — his own brother.

The victim told court that he just wants his brother to get some help.

“I have no hate for my brother, I’ll always love him,” the victim said in court during his siblng’s sentencing on Thursday.

Kenneth Victor Vivie, 23, pleaded guilty to assault with a weapon and breach of probation by having a weapon.

Police were called to a McDonald Avenue home in the early morning of Jan. 1 and found the victim lying on the ground.

He was taken to hospital with stab wounds to his chest and a punctured lung, injuries from which he continues to recover.

Reluctantly, the victim later told police that he’d been in a fight with his brother who stabbed him several times.

The victim said the fight began when he tried to intervene in a shoving match between Vivie and their sister. Vivie, on the other hand, blamed his brother for pushing the sister.

Vivie claims to have drank an “incredible” amount of alcohol in the days leading up to the stabbing.

He has been in custody since Jan. 2.

Judge John Combs sentenced Vivie to a total of one year in jail minus 137 days time served, leaving 228 days to serve.

That will be followed by two years probation with orders that he take anger management and substance abuse counselling.

The sentence was based on a plea bargain reached by Crown attorney Garry Rainnie and defence lawyer Bob Harrison.

Rainnie acknowledged the sentence was low, but without the guilty pleas it would have been tough to make a case. Most of the witnesses, including the victim, had been drinking at the time and were unco-operative.

Harrison, on the other hand, said the deal spares his client from the risk of losing at trial to face the possibility of a tougher sentence.

Vivie, by the way, is the man who was previously convicted for stabbing a man at a south-end apartment block on March 6, 2011.

For that he received one year in jail, minus 80 days time served, followed by one year of probation.

That was the probation order he breached by picking up the knife on Jan. 1.
