A 21-year-old Westman man is accused of sexually assaulting a 14-year-old girl — while serving a house arrest sentence for previous sex offences committed against another young girl.
The man can’t be named because it might identify the young complainant.
In August, he was sentenced to two years house arrest for twice trying to have sex with his then 13-year-old “girlfriend,” once when he was 19 years old and once when he was 20.
In each case, there had been physical contact of a sexual nature, but the Crown couldn’t prove sexual intercourse.
As a result, the man pleaded guilty to two counts of attempted sexual assault and also to breaching a bail condition by having contact with the girl during the second sex attempt.
While the sexual contact wasn’t forced, the 13-year-old girl was too young to legally consent to sex.
The man appeared remorseful and visibly upset during sentencing. Court heard he was assessed as a low risk to reoffend, and was noted to be responding well to counselling.
Court also heard that the victim’s mother didn’t want to see the offender go to jail.
He’s now accused of sexual assault, sexual interference and another sex charge against a different girl, reported to have been 14 years old at the time.
The offences — which haven’t been proven in court — were allegedly committed between Sept. 10, 2012 and Oct. 30, 2012 — while the accused was still serving his house arrest sentence.
The accused, who was 20 years old at the time, and the 14-year-old girl were known to each other.
The man is also accused of violating the conditional sentence order which had placed him under house arrest.
It’s alleged that between Sept. 10 and Oct. 15 he failed to keep the peace, breached his curfew and had a cellphone while banned from having them.
As of Thursday, he was in custody and will remain there until his next court date on Feb. 12.
The Crown has indicated that it will apply to have the man serve the remainder of his current sentence in jail.
