Conviction and sentence for Calgary reservist being appealed by defence

CALGARY - A veteran Canadian Forces reservist convicted for his role in a deadly training accident in Afghanistan will appeal both his sentence and conviction.

Darryl Watts was found guilty in December of unlawfully causing bodily harm and negligent performance of military duty.

He was demoted two ranks to lieutenant from major and given a severe reprimand.

His lawyer Balfour Der confirmed to The Canadian Press that he has filed the necessary paperwork for the appeal.

He says the appeal of the conviction is based on the judge not allowing the military jury to consider Watts' lack of experience in the use of the C-19 anti-personnel mine.

Cpl. Josh Baker, who was 24, died and four others were wounded when the mine loaded with 700 steel balls peppered a platoon on a practice range near Kandahar city in February 2010.
