No other reason: defence argues man mentally ill when he killed wife with hammer

WINNIPEG - The defence for a Winnipeg man on trial for beating his wife to death with a hammer is arguing he must have been mentally ill at the time.

Lawyer Greg Brodsky says there's no other reason why Miloslav Kapsik would have killed his wife of 36 years.

Brodsky said during his closing arguments that the jury should let common sense rule and find his client not criminally responsible.

Ludmila Kapsik was hit well over 100 times and the defence doesn't dispute that her husband killed her.

But Brodsky cited doctor testimony that her husband, who is charged with second-degree murder, was depressed and had psychotic tendencies.

The lawyer said the 64-year-old accused had been scheduled for a brain scan just before the killing.

Brodsky called his client a non-violent person in a loving relationship with no evidence of any violence.
