A repeat sex offender has pleaded guilty to kidnapping and sexually assaulting a five-year-old boy.
The boy — who was snatched as he played nearby his Brandon home — was targeted at random.
“A five-year-old child was picked up from his front yard … and driven away as other children watched,” Crown attorney Jim Ross said.
Hugh Alexander McCurry, 39, entered his guilty pleas in Brandon provincial court, and Ross read in the following facts.
On Dec. 12, 2011, McCurry abducted the boy as he played with other children outside his Stickney Avenue home.
Ross said McCurry stopped and opened his car door to tell the kids it was dangerous to toboggan on a hill there.
McCurry later told police that the boy climbed into the car uninvited. The boy said the man pulled him by the wrist into the car and drove off.
McCurry drove the child to a secluded spot on the north side of the Assiniboine River, near the Riverbank Discovery Centre, where he fondled the boy and forced him to perform oral sex on him.
As he touched the child, he was surprised to discover he’d abducted a boy, Ross said, adding McCurry has stated a preference for girls.
McCurry then stopped forcing the boy to perform oral sex and let him go.
About 35 minutes after he was abducted, the boy was found by police wandering near the river. He didn’t seem to be physically harmed.
At the time, semen found on the boy’s jacket didn’t provide enough DNA to be matched to a suspect.
Following court, Ross explained that in 2015, improvements to testing allowed investigators to re-examine cases in which there originally wasn’t enough DNA.
This was one of the cases that was re-examined, and it resulted in DNA from the jacket being matched to McCurry through the National DNA Databank.
The databank is used to match DNA profiles from crime scenes to convicted criminals.
McCurry has a record for sex offences that dates back to 1999 and it includes convictions for sexual interference, committing an indecent act and sexual assault.
His past offences include exposing himself to 11-year-old girls.
In 2004, he was jailed for sexually assaulting a woman by fondling her as she slept.
In 2007, he received 15 months in jail for repeatedly fondling and engaging in oral sex with a 10-year-old girl.
Police released McCurry on conditions following his
Oct. 26, 2015 arrest for kidnapping and sexually assaulting the five-year-old boy. He represented himself in court on Monday as he entered his guilty pleas.
Judge Shauna Hewitt-Michta ordered a pre-sentence report and sentencing has been set for September.
