A man accused of shooting at, and wounding, an RCMP officer during a standoff is to stand trial on a count of attempted murder.
Clayton Ewert was committed to stand trial on that and other charges at the conclusion of his four-day preliminary hearing in Brandon provincial court this week.
A ban prevents publication of any evidence, but Ewert, 49, was arrested on the evening of May 15, 2015, after police responded to a domestic dispute in Kemnay.
Based on police and witness accounts, it was alleged that a man had assaulted his common-law partner and her friend. The two women left the home, leaving the man behind, and contacted police, who were threatened by the man when they arrived at the house.
Neighbours reported hearing two gunshots. RCMP Cpl. Mark Hume was struck in the arm and leg with pellets from a shotgun blast, but wasn’t seriously injured.
After about 90 minutes, the man exited the home with his hands up and was arrested at gunpoint.
As the preliminary hearing finished, Crown attorney Christina Kopynsky and defence lawyer Bruce Bonney made recommended changes to Ewert’s list of charges.
Besides attempted murder, Judge Donovan Dvorak committed Ewert to stand trial on 12 other charges.
Those include uttering threats at police officers, assault causing bodily harm, discharging a firearm with intent to endanger life, using a gun to commit aggravated assault of a peace officer and criminal negligence causing bodily harm.
Ewert was originally charged with a second count of attempted murder in relation to a second RCMP officer who was at the scene at the time of the shooting. However, at the preliminary hearing, that charge was dismissed due to lack of evidence.
The case will appear in assignment court in Brandon Court of Queen’s Bench on June 13. No trial dates have been set.
Ewert previously had his bail denied and he remains in custody.
