A woman was given a three-month conditional sentence on Monday for her role in a nighttime theft with two other women.
Martina Chartrand pleaded guilty to theft under $5,000 after initially being charged with robbery in the July 6, 2020 incident.
Crown attorney Caroline Lacey said a woman was walking home with a friend near the intersection of 12th Street and Princess Avenue in the early morning hours.
The two parted ways before the victim was approached by a group of three women, who asked her if she wanted to go to 7-Eleven.
“(The victim) said ‘no’ and one of them said to her ‘they could drag her there,’” Lacey told the court.
She kept walking, but one of the assailants ripped the backpack she was carrying off her shoulder. The three then took off running, Lacey said.
The victim called her friend and chased the three women. She was able to catch up with them and call police, she said.
At the time, the victim was “very scared,” Lacey said, and had a broken rib from a previous incident.
It’s unclear who did what in the incident and who said what, Lacey said, but Chartrand wasn’t the one who ripped the backpack off the victim’s shoulder.
“She was, obviously, still there participating in the action with her other two co-accused,” Lacey said.
Defence lawyer Jennifer Janssens said substances and intoxication were factors in the July 2020 incident but Chartrand has been clean for the past year.
Lacey and Janssens both recommended a three-month conditional sentence order and probation.
Judge Shauna Hewitt-Michta said there is a spectrum of thefts, and the incident “doesn’t fall at the low end of that spectrum.”
“It’s much closer to a robbery than it is to a shoplifting situation … so it is concerning to the court,” she said.
She said Chartrand deserves credit for pleading guilty and addressing her addiction issue, so sentenced her to a three-month conditional sentence order, which is served in the community. Hewitt-Michta warned her that if she is caught breaching the conditions, she could spend the rest of the time in a real jail cell.
“I say all of that to encourage you to take this seriously because I promise you I take it seriously.”
She also required Chartrand to write a letter of apology to the victim and forfeit the items in the stolen bag.
