A Saskatchewan man has pleaded guilty to driving impaired and getting into an accident in the RM of Pipestone that left his passenger with six fractured ribs and a fractured vertebra.

Daniel Joyea, 42, pleaded guilty to a single count driving while impaired over 0.08 and causing bodily harm in Brandon’s Court of King’s Bench on Thursday.

Joyea was scheduled to stand trial Thursday and today, but defence lawyer Bob Harrison said his client called him and said he wanted to plead guilty to the charge.

Crown attorney Sarah Kok read the facts behind the guilty plea.

On Aug. 4, 2023, Virden RCMP received a report of a single-vehicle collision in the Rural Municipality of Pipestone. The vehicle had rolled over in the ditch and the driver and passenger were injured.

“One of the occupants … was located ejected from the vehicle a short distance away. He was airlifted by STARS ambulance, as was Mr. Joyea, who was located in the driver’s seat,” Kok said.

A sample of Joyea’s blood, which was taken when he was transported to Winnipeg Health Sciences Centre, showed he had an alcohol content of 0.137.

She said the passenger had several injuries as result of the collision, including six fractured ribs, a scapular fracture, a fracture to his T4 vertebra, along with cuts and bruises all over his body.

One of the fractured ribs caused a hemopneumothorax — when blood and air is within the space between the lungs and chest wall.

Joyea’s criminal record includes three convictions for impaired driving.

During Thursday’s plea inquiry, Joyea said he hadn’t spoken to his friend, the passenger, since the collision, and this was his first time hearing of his injuries.

The judge ordered a pre-sentence report with Gladue components — a document, which a probation officer writes, outlining the offender’s personal circumstances to help the judge determine an appropriate sentence.

Joyea’s sentencing hearing is scheduled for June 17. The Crown said there is a mandatory penitentiary sentence (two years or more) for the offence Joyea is charged with.
