A Brandon man who got in hot water when he breached his house arrest in dramatic fashion — swimming across the Assiniboine River to avoid police — will spend the rest of his sentence in jail.

Nicholas Bass, 25, was originally sentenced by Judge John Combs on May 17 to 10 months house arrest for assault charges and breach of undertaking.

The conditional sentence order directed him to have no contact with his girlfriend and he was to remain in his mother’s home and yard.

But on Thursday Bass, 25, admitted to two counts of breaching his conditional sentence order.

He and his girlfriend made an unauthorized visit together to a marriage and family counsellor on May 26 and spent the evening together.

Then, on May 30, Bass fled his mom’s Brandon home after trashing it. Apparently, he was upset to learn that his mother intended to talk to his probation officer about his girlfriend’s visit.

The mom called police to report the damage and officers arrived to find a smashed front door, a broken TV and holes in the walls.

Bass had fled by the time officers arrived but they spotted him walking on the 500-block of Kirkcaldy Drive. It was then that Bass swam across the Assiniboine, making it to the south shore before continuing his flight through brush.

The swim was in vain as police caught up with him later and made their arrest nonetheless. Bass was sent to the Brandon jail and has been in custody ever since.

In court on Thursday, his lawyer Bob Harrison asked for a suspension of his client’s conditional sentence that would allow him to serve the remainder of his sentence in the community after a stint in jail.

Combs, however, said conditional sentence orders — already viewed by the public with skepticism — need to be taken seriously and terminated the conditional sentence instead.

That means Bass will serve the remainder of his sentence — about eight months — in jail.

He also remains in custody pending on charges of sexual assault and assault in connection with incidents at the Brandon jail last month.
