A man and a youth have been charged with second-degree murder in the stabbing death of a 37-year-old man in Brandon last summer.
Joshua Chad Ross, 21, and a 16-year-old boy were arrested Thursday. They are accused of killing Ryan Daryl Benson on Aug. 8, 2023.
Ross remains in custody, but the youth was released on bail Friday afternoon by consent of a Crown attorney in Winnipeg, Chris Vanderhooft, who was handling the case.
Ryan Daryl Benson, 37, was found fatally wounded in this alley between the 400 blocks of 12th and 13th streets on Aug. 8, 2023. (File)
The boy, who cannot be named under the Youth Criminal Justice Act, is on a court order that includes a curfew and conditions to not contact his co-accused, use drugs or alcohol, or possess weapons.
Police say that on Aug. 8, Benson was at an apartment on the 400 block of 12th Street and got into an argument with Ross and the youth. The argument led to a physical altercation.
Both Ross and the youth had weapons. Police wouldn’t specify the type of weapons.
Benson received fatal wounds during the fight, while the youth’s hand was significantly injured.
Around 11:47 p.m., Benson was found in the alley between the 400 blocks of 12th and 13th streets. He was unresponsive and had suffered multiple stab wounds in his upper body. He later succumbed to his injuries.
As the Sun reported at the time, a man who lived in a house that backs onto the 12th Street alley was smoking a cigarette around 11:30 p.m., when he saw a blood-covered Benson stumbling down the alley.
The man, his roommate and son called 911 and tried to revive Benson.
The lawyer for the 16-year-old accused, Andrew Synyshyn, told the court Friday that his client was interviewed by police last summer and had remained in the community while the investigation continued.
Police say they collected DNA samples during their investigation and neither of the accused knew the victim.
Ross was arrested without incident, according to police, while the youth turned himself in on Thursday evening.
“There’s a presumption of innocence plus the fact that this is a young person with no criminal record,” Synyshyn told the Sun outside the courtroom, explaining why his client should be released on bail.
“Overall, I think that our society views that as an appropriate situation, even with serious charges, that we acknowledge that it’s important for young people to be out of custody while they go through the court system.”
Ross’s matter will next appear in Brandon court on Feb. 22, while the youth’s matter is scheduled to go before the court again on March 18.
With these latest charges, police have made arrests in all six of Brandon’s homicides last year.
