A Brandon man was handed a six-month jail sentence for his third conviction for driving while under the influence of alcohol.
Ayden Scramstad, 23, pleaded guilty in provincial court on Monday to impaired driving and operating a vehicle while he was prohibited from driving.
Both the Crown and defence agreed on the sentence for Scramstad, who was also convicted of aggravated assault last year after a jury trial in the court of King’s Bench for breaking the jaw of a 17-year-old man in 2021.
Crown attorney Matthew Dueck read the evidence for the charges to the court.
On Oct. 16, 2023, Scramstad had a sentencing hearing in King’s Bench for his aggravated assault conviction. However, that day, police were called to the 300 block of 10th Street after a report that a vehicle had just run a red light and grazed another vehicle.
Police located the vehicle on 14th Street and when they approached it, Scramstad tried to move to the passenger’s seat.
When officers asked him to open the car door, he struggled, and officers had to stabilize him as he stumbled and slurred his words.
Dueck said that Scramstad was dressed in dress pants and a blazer — appearing to be on his way to court. Samples of his breath that day registered a blood-alcohol concentration of more than three times the legal limit.
“I think the biggest concern for the Crown is that he obviously has a criminal record that’s rapidly growing since 2019,” Dueck said, noting Scramstad’s previous convictions for assault and impaired driving.
Scramstad’s defence lawyer, Jonathan Richert, told the court that his client has struggled with ADHD, depression and anxiety in addition to an alcohol addiction that spiralled after the death of his close friend.
“He’s a young man. There is hope for a better future for him if he can get a handle on these addictions issues and some of these mental health issues (and) get proper treatment for them and stop self-medicating in unhealthy ways,” Richert said.
Judge Shauna Hewitt-Michta ultimately agreed with the six-month sentence, noting that it gives the 23-year-old credit for pleading guilty.
“Mr. Scramstad, you’re going to kill someone. I can’t put it more bluntly than that,” the judge said. “You need to deal seriously with the addiction issue.”
After being credited for time served, Scramstad will serve five months behind bars. He was also sentenced to a four-year driving prohibition.
Scramstad is scheduled to be sentenced in the court of King’s Bench for the aggravated assault conviction on May 24.
