A 22-year-old Brandon man was sentenced to more than a month in jail after pleading guilty to assaulting a bouncer outside of a local nightclub.

Arner Rivera, 22, pleaded guilty to assault in provincial court on Monday. He also pleaded guilty to breaching his probation by possessing a pocketknife, which police found when he was arrested for the assault.

Both the Crown and defence agreed on a 45-day sentence for the man. Crown attorney Sarah Kok read the evidence for the charges to the court.

In November 2023, around 1:20 a.m., Brandon police were dispatched to the Great Western Roadhouse for a report that a staff member had been assaulted.

According to a statement from one of the nightclub’s bouncers, Rivera began threatening other patrons and security officers. Staff told Rivera that he needed to leave the club because of his aggressive behaviour.

After he was forcibly removed from the nightclub, the bouncer told police that Rivera said that he wanted to fight. Then, Rivera came toward the bouncer. As the bouncer attempted to take Rivera to the ground, Rivera hit him in the nose during the scuffle.

Staff members had to hold Rivera’s arms while he was on the ground until police arrived.

The bouncer didn’t require any medical attention and did not have to miss any work after the incident, but was concerned about Rivera’s level of unprompted violence, the Crown attorney said.

Police noted that Rivera was highly intoxicated and needed to be transported to the hospital for medical clearance.

“Obviously, this bouncer was simply trying to do his job and trying to maintain safety,” Kok said.

Rivera’s defence lawyer, Melissa Jenin, told the court that her client has been working on getting his life back on track and was able to become sober after a stint in jail.

She said Rivera, who grew up in Honduras, has two children and doesn’t remember much of that night with the bouncer because he was intoxicated.

Rivera apologized to the court and said he was involved with programming to help address anger management issues.

Judge Shauna Hewitt-Michta agreed with the 45-day sentence, saying that even though it was on the lower end of the sentence range, it gave Rivera credit for his guilty pleas.

She also sentenced him to a term of probation and an order to not attend the Roadhouse.

Since Rivera has already spent about two and a half months in jail, he received time served.
