A man who stole an SUV and fled from police when they tried to stop him was sentenced to roughly one year in custody on Tuesday.

Terrance Moar, 30, pleaded guilty to theft of a motor vehicle and flight from police in Brandon provincial court ahead of receiving his sentence.

The lawyers presented a joint recommendation of a time-already-served sentence equivalent to 368 days, followed by two years of unsupervised probation.

Crown attorney Caroline Lacey read the facts behind the guilty plea.

Just after midnight on Dec. 28, 2024, officers with the Brandon Police Service were patrolling Cornell Bay when a pedestrian ran toward the cruiser and told them that three people had stolen his grandmother’s Jeep Cherokee, which he was using at the time.

The complainant went to BPS headquarters to give a formal statement, and police informed other officers of the incident through radio.

At around 12:40 a.m., an officer spotted the vehicle travelling on Pacific Avenue.

“Police see the driver, and they’re able to identify him as Mr. Moar,” Lacey said. “The vehicle speeds up to about 70 kilometres an hour. Police activate their emergency lights to conduct a stop. The Jeep didn’t stop.”

One of the sergeants called off the pursuit.

On Dec. 31, police went to Moar’s last known residence. He answered the door, and police arrested him without incident.

Lacey called the joint recommendation a “true plea bargain” and said identification could have been an issue, since police did not arrest Moar on scene and it’s not known how long police saw him.

Additionally, she said contact with the victim was also an issue.

“The victim contact was there at first, and then it became non-existent. So again, another reason that we’re here today, taking the pleas that we have, and for the sentence that we are recommending,” Lacey said.

Defence lawyer Kirk Knudsen said Moar has taken responsibility for his actions and is remorseful. He said after Moar is released, he plans to move back to Crane River, where he is originally from, and his girlfriend and his daughter plan to move in with him.

Knudsen said Moar described his partner as a “positive influence on his life” and said he plans to live a more pro-social life going forward.

“I submit that it is a fit and appropriate sentence under the circumstances, and one that does satisfy the principles of sentencing of deterrence, denunciation and certainly rehabilitation as well,” Knudsen said.

Judge Robert Heinrichs went along with the joint recommendation and told Moar that this was a chance for him to make a change.

“Maybe it’s time to turn your life around,” he said. “I think you can do it. Hopefully you’ve been thinking about that long enough sitting in jail this year.”
