A father admitted in court that he purposely violated his probation order so he could be sent to the Brandon Correctional Centre to support his son who’s serving time there.
Dominic Dowan, 46, pleaded guilty to breaching a probation order from November 2024 that prohibits him from owning, possessing, carrying or converting anything into a weapon.
Crown attorney Caroline Lacey said Dowan’s reasoning for wanting to go to jail was “bizarre.”
“That’s just ridiculous and honestly a waste of police time to be having to deal with someone trying to go into jail to support someone else,” Lacey said in Brandon provincial court on Thursday.
She said police arrested Dowan after he showed up at the Brandon Police Service headquarters on July 6 with a white sock filled with rocks. He asked officers to arrest him and explained that he needed to go to jail because he wanted to be with his son.
Defence lawyer Anthony Dawson said his client has four children ranging in age from 14 to 25, and has a fifth child on the way. Dowan is also a grandfather to one child, Dawson said.
Dowan has spent 24 days in custody, bringing the total amount of time served to 36 days with enhanced credit.
“He has more than enough for time served at this point,” Dawson said.
Judge Shauna Hewitt-Michta sentenced him to 36 days in jail, including enhanced credit. As Dowan has already served this time, he was released from jail on Thursday.
“I understand as a parent being concerned about the welfare of your kid,” the judge said. “But, you know, this was a waste of public resources and not the right way to handle the situation.”
When Dowan told the judge he was strip-searched for drugs prior to being detained, Hewitt-Michta said she hoped this experience was “unpleasant enough” to dissuade him from making the same choice again.
