A 32-year-old man admitted to screenshotting an intimate image of his former partner before showing it to the woman’s daughter in a 2021 incident that occurred in Virden.
A three-day Manitoba Court of King’s Bench trial — set to begin Wednesday in Brandon — was cancelled after the accused pleaded guilty to making an intimate image available without consent from Nov. 19-21, 2021. The Crown stayed an assault charge.
The Sun is not naming the accused to protect the identity of the 37-year-old victim.
“We understand the accused is saying when this happened, he was under the influence of alcohol and his judgment was largely impaired,” Crown attorney Rich Lonstrup said in court Wednesday.
The accused screenshotted a naked image of his ex on her phone that she had sent to a third party and showed it to her daughter while making “vulgar” and “sexualized” comments about the woman, Lonstrup said.
“It shows he had animus and intention to do her injury to her reputation but wasn’t just out to only show the photograph,” he said.
The accused also tried showing the image to the daughter’s boyfriend in the presence of the victim, Lonstrup said.
“He had no permission to do that. No permission to access the photo,” he said.
Defence lawyer Eric Wach told his client he would be seeking a conditional sentence while the Crown would be suggesting time in custody during his sentencing that’s scheduled for Oct. 22, 2027.
A pre-sentence report was not ordered.
