The bail hearing for a man accused of second-degree murder was delayed on Monday morning.

Desmond Tanner is charged with second-degree murder in the August 2019 death of Matthew Swain.

Tanner was scheduled to apply for bail on Monday morning in the Brandon Court of Queen’s Bench in front of Justice John Menzies. But defence lawyer Anthony Kavanagh said new information had come up last week and asked to delay the hearing. He said there were also changes to be made to Tanner’s prospective bail plan.

No other details were read in court on Monday.

Swain, who was 40 years old when he died, was found by the RCMP on Aug. 14, 2019, near the Russell Airport.

Police said at the time Swain was assaulted. He died as a result of his injuries after being transported to hospital.

While Swain died in August 2019, charges were not laid in his death until March 1, 2021, more than 18 months later.

Robert Fleury, 34, was charged with manslaughter in Swain’s death. Neither man’s charge has been proven in court and both are still before the court.

A new date for Tanner’s bail hearing is expected to be set in November.
