SASKATOON – Saskatchewan’s highest court has dismissed a Crown appeal and upheld the stay of a driver charged in the death of a nine-year old girl. 

The Court of Appeal says the charge against Taylor Kennedy was properly stayed. 

Kennedy was charged in March 2022 with driving a vehicle while impaired and causing the death of Baeleigh Maurice.

The girl was going to school in 2021, when she was struck while pushing her scooter at a crosswalk. 

A judge stayed the charge in December 2024, finding it wasn’t possible for the trial to finish within a reasonable amount of time.

The Appeal Court says the Charter guarantees every person charged with an offence is tried within a reasonable time. 

It says Kennedy’s trial would have significantly exceeded what’s allowed.
